Board of Adjustment / Appeals

The Board of Adjustment and Appeals hears and decides appeals under City ordinance, Commission resolution and City code — housing and building regulations — and hears and decides requests for variances under Title 17 of the OfficialCode. It also hears any appeal where an ordinance or resolution specifically names it, under OCCGF 2.9.030.

Created under MCA 76-2-321 and following, and by Ordinance 2923 of September 2005, the Land Development Code, at OCCGF 17.12.5.010; revised by Ordinance 3205 in October 2019.

Membership — five members appointed by the CityCommission, all City residents under OCCGF 17.12.5.030.B. Three-year terms, holding over until a successor is appointed.

Meets on demand. Its recordings are catalogued under the file prefix BOA.

MLUPA review

In January 2026 the City noted that staff were reviewing and proposing code changes to comply with the MontanaLandUsePlanningAct, and that current board members would continue to serve as needed until the code could be amended to say clearly which bodies hear appeals. The question was taken to the Commission at WorkSession2026-01-20 underr the heading of MLUPA code compliance, variances and appeals.
